Terms and Conditions

The Human Rights Hub (www.humanrightshub.ca) is a platform run by Stuart Murray. This project has received financial support from the Winnipeg Foundation.

This Agreement sets out the terms and conditions for your access and use of the Human Rights Hub. The use of this website in any form binds you to this agreement and all related policies, conditions and guidelines. If you do not accept these terms in full, please do not use the website.

1. YOUR RELATIONSHIP WITH THE HUMAN RIGHTS HUB

​

1.1 Your use of this platform and any of its services is subject to the conditions of the legal agreement between you and the Human Rights Hub. This agreement is both the terms and conditions laid out in this document, as well as the Privacy Policy. Together, this agreement applies to all users of the platform.

2. ACCEPTANCE OF TERMS

​

2.1 These terms, as well as the Privacy Policy, constitute the legal agreement between you and the Human Rights Hub. By using this platform, you signify your acceptance and agreement of these terms, as well as the acceptance and agreement of any organization that you represent on this platform.

2.2 These terms and conditions will be governed in accordance with applicable provincial and federal laws. Any disputes will be subject to the exclusive jurisdiction of provincial and federal courts. To enforce any term of this agreement, one must be a party to these terms.

3. CHANGES TO THE TERMS

3.1 We may revise or amend these terms and conditions at any time at our sole discretion. We will always post the up-to-date terms and conditions on this webpage. If any substantial changes are made, we will make an announcement on the Human Rights Hub’s home page. Please visit this page periodically to review our current policy. If you do not agree with changes made to these terms and conditions, please stop using this service.

4. HUMAN RIGHTS HUB ACCOUNTS

​

4.1 In order to post content on the Human Rights Hub, you will have to create an organizational account. This account must have accurate and complete information. Do not create an account for any other individual unless you have their authorization. Do not create an account representing an organization that you do not have explicit permission to represent. Please keep your log-in information secure and confidential. Do not let other people use your Human Rights Hub organizational account to share or post information.

5. RULES OF CONDUCT

​

5.1 The Human Rights Hub includes features that allow you to post, submit, provide and upload content, as well as to interact with other user accounts. When using this platform, it is a condition of your use that you agree to the following:
You are required to create a username and password to access and use certain features of the website.
You are responsible for all activity that occurs under your username.
You will not upload, post, email, submit, transmit or otherwise make available any content, materials or information through the Human Rights Hub that is racist, fraudulent, unlawful, offensive, threatening, abusive, harassing, defamatory, obscene, pornographic, invasive of another’s privacy or hateful, or that infringes the rights or inhibits the use and enjoyment of the site by any third party.
You will not post or upload any content that infringes the copyrights or trademarks of another person or entity.
You will not post or upload any unsolicited or unauthorized advertising, or any other form of “spam”. This includes using the Human Rights Hub and its services (including the comments feature) for the solicitation of business in the course of trade or in connection with a commercial enterprise.
You will not use the Human Rights Hub for any illegal or unauthorized purpose.
You will not copy, reproduce, transmit, broadcast, sell, license, or otherwise exploit any content for any other purposes without the prior written consent of Global College or the respective licensors of the content.
You will not misrepresent your identity or affiliation with any other person, group or organization.
You will not access or use another account without permission.
You will not violate the security of the website, including, without limitation:
accessing data not intended for you, including logging into a server or user account which you do not have authorization to access;
using or launching any automatic device, program, algorithm or methodology, or any similar or equivalent manual process to access, acquire, copy or track any portion of the Human Rights Hub, or in any way reproduce or evade the navigational structure or presentation of the Human Rights Hub, to obtain or attempt to obtain any materials, documents or information through any means not purposely made available through the Human Rights Hub;
attempting to scan or test the vulnerability of a system or network to circumvent, disable, disrupt or otherwise interfere with any security related features of the
Human Rights Hub or features that enforce limitations on the use of the Human Rights Hub or the content accessible via the Human Rights Hub;
tracing or seeking to trace any information on any other user to its source, or misuse the Human Rights Hub or any information made available through the Human Rights Hub, in any way where the purpose is to reveal any information, including but not limited to personal identification or information, other than your own information, as provided for by the Human Rights Hub;
taking any action that imposes an unreasonable load on the infrastructure of the Human Rights Hub’s system or network;
attempting to interfere with or disable service to any user, host or network, including, without limitation, by way of “denial of service” attacks, overloading, “flooding”, “mailbombing” or “crashing”;
disrupting network nodes or network services or otherwise restricting, inhibiting, disrupting or obstructing the ability of Global College and Full Current to monitor or make available the Human Rights Hub; or
taking any action in order to obtain services to which you are not entitled.

6. USER CONTENT

​

6.1 This site and its services, provide areas that allow for adding events, blogs, or other message and communications features. The Human Rights Hub requires that you agree to post only events and comments that are respectful, lawful, and related to the purpose of the site itself.

6.2 If you upload copyright-protected content, it is your responsibility to ensure that you have the copyright owner’s written consent.

6.3 You may only post events that are relevant to Human Rights; events that are outside of, or irrelevant in relation to the goals of this website will be removed. Without limitation, you may not post any other activity on the site that:

  1. defames, threatens, abuses or otherwise violates the legal rights of others;

  2. is harmful to any individual, profane, obscene, indecent or racially or ethnically offensive;

  3. infringes another’s rights to intellectual property, publicity, or privacy;

  4. impersonates any person or entity or misrepresent your connection or affiliation with a person or
    entity; or

  5. constitutes illegal activity.

7. LINKS FROM THE WEBSITE

​

7.1 The Human Rights Hub may share external links that lead the user to third-party sites. The Human Rights Hub is not responsible or liable for the content, privacy policies, or practices of any third-party sites.

8. THIRD-PARTY CONTENT FEATURED ON THE WEBSITE

​

8.1 The Human Rights Hub may share articles, photographs, videos and other content from third parties. While we check this content for accuracy and appropriateness, we are not responsible for this third-party content that is posted on the platform.

9. INTELLECTUAL PROPERTY

​

9.1 The Human Rights Hub name and logo may not be used in connection with any product or service that it does not approve. Other trademarks that appear on this site (e.g., organizations’ logos) are the property of their respective owners and are subject to their restrictions.

9.2 You do not acquire ownership rights to any content obtained, accessed or viewed through the Human Rights Hub.
9.3 By making your user content available through the Human Rights Hub, you automatically grant to Global College a royalty-free and perpetual right and licence to use, copy, distribute, transmit, host, market, create derivative works of, modify and display the user content and any intellectual property rights therein (including but not limited to any copyright, trademark, publicity and database rights), in any form, technology or media now known or later developed, without providing compensation to you or anyone else, without any liability whatsoever, and free from any obligation of confidence or other duties on the part of Global College.

10. COPYRIGHT POLICY

​

10.1 All content on the Human Rights Hub is owned by Global College and is protected by the applicable intellectual property and proprietary rights and laws. You are responsible for acting in compliance with all applicable laws, particularly copyright laws.

10.2 All commercial use or publication is strictly prohibited without prior authorization from the Human Rights Hub. You may print pages from this site for non-commercial and non-profit use, subject to the condition that you do not modify the content or alter any identification, marks, notices or disclaimers.

11. EXCLUSION OF WARRANTIES

​

11.1 Nothing in these terms and conditions shall affect any statutory rights that you are always entitled to as a consumer and that you cannot contractually agree to change or waive.

11.2 The Human Rights Hub is provided without any warranty of any kind whether express or implied.

11.3 The Human Rights Hub does not warrant to you that:
your use of the Human Rights Hub will meet your requirements;
your use of the Human Rights Hub will be secure or free from error;
any information you obtain from using the Human Rights Hub will be accurate or reliable;
its website or server are free of viruses or bugs;
it represents the full accuracy and functionality of the materials; and
that defects in the functionality of any software pertaining to the Human Rights Hub will be corrected.

11.4 No conditions, warranties or other terms (including any implied terms as to conformance with description or satisfactory quality) apply to the Human Rights Hub except to the extent that they are explicitly set out in these terms and conditions.

12. LIMITATION OF LIABILITY

​

12.1 Nothing in these terms and conditions shall exclude or limit Global College’s liability for losses which may not be lawfully excluded or limited by applicable law.

12.2 Global College shall not be liable to you for:
any indirect or consequential losses which may be incurred by you or the organization you represent. This includes any loss of profit (whether incurred directly or indirectly), any loss of goodwill or reputation, any loss of opportunity or any loss of data suffered by your or the organization you represent.
any loss or damage which may be incurred by you or the organization you represent due to:
any reliance you place on the accuracy or existence of any materials contained on the Human Rights Hub;
any changes which Global College may make to the Human Rights Hub, or for any temporary or permanent discontinuance in the provision of the Human Rights Hub or any features within the Human Rights Hub;
your failure to provide Global College with accurate account information; and
your failure to keep your password or Human Rights Hub account details secure and confidential.

12.3 If there is a dispute between you and any other user of the Human Rights Hub, Global College is under no obligation to become involved, and you hereby release Global College from any claims, demands or damages of any kind and of any nature arising out of or relating to any such dispute.

12.4 These limitations of liability shall apply whether or not Global College has been advised of or should have been aware of the possibility of any such losses arising.

12.5 By accessing and using the Human Rights Hub, you agree the above-stated limitations of liability are reasonable and in keeping with the nature of the Human Rights Hub.

13. INDEMNITY

​

13.1 By accepting these terms and conditions, you agree to indemnify and hold Global College harmless from any and all claims, demands, liabilities or expenses, including reasonable legal fees, arising out of any claim made by any third party or any action taken by any governmental or regulatory body, due to, arising out of or relating to:
your use of or connection to the Human Rights Hub;
any content that you post, transmit, provide or otherwise make available through the Human Rights Hub;
your actual or alleged breach of these terms and conditions;
your actual or alleged infringement of any third party intellectual property or proprietary rights; or
your actual or alleged violation of any applicable laws, rules, regulations or rights of another.

14. ENDING YOUR RELATIONSHIP WITH THE HUMAN RIGHTS HUB

 

14.1 The Terms laid out in this document, as well as the Privacy Policy, are applicable until terminated by yourself or the Human Rights Hub.

14.2 If you wish to terminate this agreement with the Human Rights Hub, please delete your account and notify us at christie@humanrightshub.ca.

14.3 The Human Rights Hub may choose to terminate this agreement with you if you breach any provisions of the agreement or we are authorized or required to do so by law.
